The only Class Action lawsuit against AMBER GOLD admitted to a hearing
On September 23rd 2015, the Warsaw Court of Appeal made a final admittance to a hearing of the class action lawsuit by AMBER GOLD clients against the BGŻ BNP PARIBAS Bank.
Pursuant to the justification of the Warsaw Court of Appeal, in an explanatory statement the plaintiff pointed out common factual circumstances for all members of the group that will legally justify the existence of all premises of the defendant’s tortious liability, including circumstances under which the damage occurred and the causal relationship (…). The plaintiff pointed out the cause of injury by referring to the conclusion of the same agreements with AMBER GOLD, as well as to the authentication of the business activity of the company in the eyes of the group members involved in the cooperation with the summoned Bank of a high reputation, including the depositing of funds into the Bank’s account, the Bank’s knowledge concerning the illegality of AMBER GOLD’s business activity as well as the Bank’s failure of denunciation and the failure to recover invested funds.
In the further course of the legal proceedings, the District Court will announce the possibility of all persons involved in similar factual circumstances to join the proceedings as members of the group which initiated the class action.
